Mr. Mollenhauer is a Licensed Attorney and graduate, Civil Engineer with several years' experience in the Surety industry. Mr. Mollenhauer has held the position of Surety Claims Manager at two of the nation’s leading Surety providers. Mr. Mollenhauer's experience as a Civil Engineer includes specializing in job-site construction inspection, supervision and documentation.
Recent Experience
As Vice President, Surety Counsel-Claims Manager for Kemper Surety, Mr.
Mollenhauer was responsible as a Corporate Officer, specifically recruited by
Kemper to create and lead a team of attorneys and claims professionals
providing legal and technical expertise for Kemper's Surety operations and the
Surety executive leadership team. Mr. Mollenhauer's responsibilities included:
providing counsel to home office Surety executives; directing efforts of senior
staff, local counsel and technical consultants on major construction and
commercial account defaults; directing and monitoring major litigation;
creating strategy and managing both technical and operational aspects of
nationwide claims team through the development of standardized claim practices
and procedures, implementation of financial controls and standardization of
internal reporting practices.
As Senior Surety Counsel-Claims Manager for Fireman's Fund, Mr.
Mollenhauer's responsibilities included: directing senior staff, local counsel
and technical consultants on major construction defaults; personal
investigation and resolution of commercial Surety and complex contract Surety
claims; provision of counsel to regional underwriting offices; and development
and implementation of quarterly review programs.
Analysis of claim documents to determine propriety of contractor defaults
and review of compliance with applicable bond and statutory
requirements.
Negotiation of take-over, tender and settlement agreements and monitoring of
performance of Completion Contractors through job-site meetings and site
inspections.
In-house consultant to claim counsel/adjusters on technical issues by
inspecting construction sites, reviewing contract documents and preparing
reports.
As Project Engineer/Construction Inspector for an Architectural and
Engineering consulting firm, responsible for performing daily on-site
inspections of construction activities for various public agencies while
supervising construction of structural concrete, drainage systems, pavement,
and earthwork. Also conducted testing on construction materials including
concrete, asphalt and soil; and prepared quantity and daily work reports to
document construction activities.
